These Text Message Terms and Conditions (“SMS Terms”) govern participation in Avicado’s SMS/MMS messaging program (the “Messaging Program”). By opting in to receive text messages from us, you agree to these SMS Terms.  

 

1) Program Description   

The Messaging Program is used for recruiting and hiring-related communications, including but not limited to:  

  • Job application updates  
  • Interview scheduling and reminders  
  • Recruiter outreach regarding employment opportunities  
  • Candidate status notifications  
  • Hiring event invitations  
  • Follow-up communications related to employment opportunities with Avicado  
  • Messages may be sent using automated technology.  

We will identify Avicado as the sender in messages (except in the context of an ongoing conversation thread where the sender is already clear).  

 

2) Consent / OPT-IN  

By voluntarily providing your mobile number and opting in to receive text messages, you expressly consent to receive recruiting-related SMS/MMS communications from Avicado at the number provided. 

Consent is specific to Avicado and this Messaging Program and is not transferable.  

Consent to receive text messages is not a condition of employment or consideration for employment. 

You represent that you are the account holder or have authorization to enroll the number you provide.  

We maintain records of opt-in consent. If we do not send an initial message within a reasonable period after you opt in, we may reconfirm your consent in our first message.  

 

3) Message Frequency

Message frequency varies depending on your interactions with our recruiting and hiring process.  

 

4) Costs 

We do not charge for the Messaging Program, but message and data rates may apply as determined by your mobile carrier and plan.  

 

5) OPT-OUT 

You can opt out at any time by replying STOP to any message.  

You may also use other standard opt-out keywords such as STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, or OPT-OUT.  

After you opt out, we may send one final message confirming your choice to opt-out. After that, you will not receive further messages unless you opt back in.  

To opt back in (where available), reply START or follow the instructions provided.

7) Privacy; No Sharing of Mobile Information for Marketing   

Information collected through the Recruiting SMS Messaging Program is subject to our Privacy Policy: https://avicado.com/privacy-policy/ 

We do not sell or share mobile numbers with third parties or affiliates for their own marketing or promotional purposes. We may share information with service providers that support our recruiting, hiring, and communication processes. 

Our messaging providers may monitor message activity to help detect spam, fraud, security risks, or misuse of the platform. 

 

8) Delivery; Carrier Disclaimer 

Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier’s network and your device.  

 

9) Compliance and Program Integrity 

We will only send messages consistent with the opt-in you provided and applicable law.  

We do not send content that is illegal, harmful, fraudulent, or otherwise prohibited, and we do not attempt to evade carrier or platform filtering.

10) Changes or Termination 

We may modify or discontinue the Messaging Program at any time.  

We may update these SMS Terms by posting a revised version with a new Effective Date. Continued participation after changes become effective constitutes acceptance of the revised SMS Terms.  

 

11) Limitation of Liability 

To the extent permitted by law, Avicado and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of the Messaging Program.  

Our total liability for claims related to the Messaging Program will not exceed $100 or the amounts you paid to participate (if any), whichever is greater.  

 

12) Governing Law 

These SMS Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles.
